Terms of Service

Effective October 30, 2026 · Version 2026-10-30

These terms govern OohVies, the operator of oohvies.com ("OohVies," "we," or "us"), and its website, viewer accounts, filmmaker portal, and advertising services. A separately signed distribution agreement or advertising order controls its specific subject if it conflicts with these general terms. The Privacy Notice describes data handling. Content Guidelines, Filmmaker Terms, Advertising Terms, and Copyright Policy apply to the activities they cover.

1. Eligibility and acceptance

You must be at least 18 and legally able to enter a contract to create an account, submit content, or buy services. The service is not directed to children. Family titles do not create a child account service. Use must comply with age ratings and local law. By checking the acceptance box, you agree to the identified version of these terms; viewing public pages alone does not represent a signed distribution agreement. A business representative must have authority to bind the business. Do not use a service if you do not agree to the terms that apply to it.

2. Accounts and security

Give accurate information, protect your credentials, and promptly report suspected unauthorized use through Contact. Do not sell or transfer accounts, impersonate another person, share Studio access, evade suspension, or attempt access to another person's records. You are responsible for activity you authorize through your account, subject to applicable law. Viewer registration does not confer filmmaker approval or administrator access.

3. Limited viewing permission

Subject to these terms and available licenses, we permit personal, noncommercial viewing through the provided player. No ownership of films, artwork, software, trademarks, or music transfers to you. No downloading except where explicitly enabled, recording for redistribution, public exhibition, rebroadcasting, sublicensing, scraping, automated harvesting, DRM circumvention, or removal of ownership notices is permitted without the necessary written authorization. Lawful fair use and other rights that cannot be restricted by contract remain unaffected.

4. Availability and third parties

Titles, territories, devices, captions, and features may vary or be withdrawn for rights, security, operational, or legal reasons. We do not promise uninterrupted availability. Third-party hosts and payment processors have their own terms and privacy practices. A link or advertisement is not our endorsement. Your internet or device charges remain your responsibility. Clearly marked placeholder artwork, demonstration analytics, projections, and sample agreements are not playable licensed films, actual revenue, verified audience results, or executed contracts.

5. Charges and refunds

Creating an account is free. The current filmmaker title submission fee is $19.99; optional promotion starts at $100 for the filmmaker's own submitted title. A supplied commercial must be 15 seconds; requested OohVies commercial creation adds $300. No payment guarantees approval, distribution, placement, audience, earnings, or launch selection. Saving a form does not charge a card. Online checkout, automated payouts, and other disconnected services are unavailable until explicitly activated.

A payment requires a separate, disclosed authorization stating the service, price, taxes if applicable, cancellation terms, and processing stage. No automatic renewal or recurring charge is authorized by these terms. For a paid submission review, the fee becomes earned when review begins; before then cancellation qualifies for a refund. Rejection after a completed review does not by itself qualify for a refund. Unperformed creative services and undelivered prepaid promotion remain subject to the written order, applicable law, and refund or make-good for undelivered services. We will correct duplicate or unauthorized charges and refund services we cannot provide as required by law. No clause waives statutory refund or payment-dispute rights.

6. Enforcement

We may review submissions, request evidence, refuse content, restrict accounts, pause campaigns, or remove material for suspected violations, rights disputes, fraud, safety concerns, or legal requirements. An immediate restriction may be necessary to prevent harm; when appropriate we will provide notice and a chance to respond. Contact us to request review with your account and title or campaign reference. We may preserve relevant evidence and respond to valid legal process. Suspension does not erase earned payment obligations, accrued lawful remedies, or required refunds.

7. Warranties and limits

To the fullest extent permitted by law, services are provided as available and without implied warranties of merchantability, fitness for a particular purpose, or noninfringement. We do not guarantee commercial success, accuracy of third-party content, or error-free security. Nothing limits any express promise in a signed agreement or any warranty required by law.

To the fullest extent permitted by law, OohVies and its officers, directors, employees, and authorized agents are not liable for indirect, incidental, consequential, special, or punitive damages, including lost profits or goodwill. Our aggregate liability arising from these general services will not exceed the greater of $100 or the fees you paid OohVies for the affected service in the preceding 12 months. This cap does not reduce earned contractual payouts, required refunds, or liabilities that cannot lawfully be excluded or limited, including fraud, willful injury, gross negligence where nonwaivable, violations of law, or mandatory consumer remedies. A signed agreement may provide additional protections.

8. Business indemnity

If you submit films, advertisements, or other material in a business capacity, you will defend, indemnify, and hold harmless OohVies and its officers, directors, employees, and authorized agents from third-party claims, damages, judgments, and reasonable legal costs to the extent caused by your material's infringement, missing clearances, unlawful advertising, misrepresentation of authority, or your material breach. This does not cover OohVies' own unlawful conduct or fault. We will give prompt notice and reasonable cooperation. Counsel must be reasonably acceptable; no settlement may admit fault, impose nonmonetary obligations on us, or fail to release us without our written consent. We may participate with our own counsel. Nonwaivable rights remain intact.

9. Disputes and general provisions

California law governs to the extent consistent with mandatory law where you live. Subject to nonwaivable jurisdiction and small-claims rights, disputes may be brought in the appropriate state or federal courts in Los Angeles County, California. Contact us first if practical, but this does not prevent timely legal action, reporting to authorities, or urgent relief. These terms do not impose mandatory arbitration, waive class claims, or bar truthful reviews.

Material changes will be dated and notified through the service or an available contact method; where required, renewed acceptance will be requested. Changes do not retroactively alter accrued claims or signed agreements without lawful consent. Invalid provisions will be limited or severed while the rest remains in effect. Failure to enforce once is not a waiver. No partnership, employment, or agency is created. Contact details are available at Contact.
